    This is a situation which has been going on forever and there really is little that can be done about it. I've been making copies of material since the late 50's when I transferred lp's to reel to reel and gave copies to my friends. Then it was cassettes, CD's, VHS, and DVD's. The internet is just another way to obtain material and I'm sorry to say that the small number of pirated material wouldn't involve a large scale investigation. Lukas will have to hire a lawyer and pursue this himself. Lukas needs to concentrate on the fact that his material is collectible and sell it as such. Any collector would have 0 interest in a knockoff and his product is special and unique to a few thousand people in the world.

    Tiresome , though I understand Lukas' position and frustration on the matter .
    If you like the music - just buy it , don't have the money - try and safe up for it .

  2. Yeah, let those with cash blind buy it. If they don't like it, then those with low funds who wanted, can buy a really great used copy at a reduced price, and FSM recoups ther costs Lukas said he was worried they would not.

    This is an issue that will not go away. I know people who buy the best selling books they're interested in at Costco and then return them after reading it. I know people who will go to a multiplex theater for a movie and have no qualms of going to another and another film once the ticket has been purchased. I know people who borrow the disability sign and use it and they're not disabled at all. This one really touches a nerve with me because I am disabled but little or nothing can be done about it.

    The same person that involves himself in the piracy probably wouldn't go to Borders and steal the CD because in their opinion this is wrong but in reality it is a similar scenario. This person is living by a certain set of moral standards. We're all guilty of not being a saint 100% of the time in our lives. Reusing a postage stamp on a package that wasn't cancelled is wrong but people do it anyway. If you go to the store and the clerk doesn't charge you on checkout for one item most people will not go back to the store and pay for it. They justify that its ok because they've been charged twice for the same item and didn't go back to the store to be refunded so one mistake cancels out another. Most people have sex before marriage, have driven with having too much to drink, cheated on their income tax, and any number of other things.

    I'm sorry it has happened but short of paying out a huge amount in lawyer fees and putting the offender in prison nothing is going to happen. Prison time would get their attention but the price would be rather steep. Enough said.

    Just today at JWFan.com, a member posted his trading list, with FSM titles in it. He's apologized and amended it saying he will not offer in-print titles.


    Another member, in the FSM thread said he saw the error in his ways a while back, and deleted everything he got illegally.


    And I, for the record, have never cheated on my taxes. Not even a little. The I.R.S. did tell me this year I provided the wrong amount for the EIC, but I got that amount from them, so...

    Now that's just silly. Once you've legitimately bought a CD, you can do with whatever you wish - including selling it again if you don't want it. I've done so many times, and will continue to.
    I am extremely serious.

    I'm assuming that's where hte confusion lies, and you are seriously not implying one can do whatever they want to do with their pruchased CD , like make illegal copies of it when you can go buy it.

    The fsm-not-sharing thingy is just temporary. Even in ffshrine with their supposedly huge ban of varese titles, varese titles DO pop up from time to time, even not as openly as the rest labels'. It's just to ease the fire a bit.

    For all that I sympathise with Lukas's position, I find it highly unlikely that the reason a $150 box set of music with extremely questionable musical value might not be selling well is because of online piracy. Clearly, if there's even one person who has downloaded it who would otherwise have bought it then there's no argument, it's a bad thing indeed for FSM and has cost them money, but this box set was always going to be a tough sell. A lot of soundtrack sales rely on goodwill of people and a sense of nostalgia rather than genuine interest in the music for music's sake (and that's the way the labels have decided to play the game, evidenced by so many of these things being presented in indiscriminate chronological-and-complete format, warranted or not) and that can get you so far when it's $20 a pop, but probably not very far at all when it's $150. (I'm not condoning the piracy - just saying that I doubt that it has had a particularly great impact on the sales of this particular title. But then, what do I know?)

    What bothers me about this is that people never seem to acknowledge the promotional effects downloading has. People who download a score illegally, still end up on message boards ranting about how much they love the music, just like everyone else, thereby having positive effects on sales. There is no doubt that illegal downloading can generate lost sales as well, when people choose to download instead of buy. But the people who wouldn't otherwise have bought an album, but downloads it for free, can only generate potential positive effects on sales (provided he likes it and talks about it of course). I sometimes wonder how small and insignificant boards like FSM, filmtracks and maintitles would be if people didn't download illegally.

    In my impression, the people who download illegally tend to be the ones buying albums as well. No doubt there are people who download exclusively and people who buy exclusively, but I bet they are fringe minorities. Most fans of the music tend to use whatever means they have at their disposal to acquire music, and these people are the ones the labels earn a living from.

    Overall, it's difficult to say whether sharing harms or helps sales as there are factors pointing in either direction. And yet, there are plenty of simplistic and fanatical outcries out there advocating either position as the absolute, undeniable truth.

I think with both the Ron Jones box set and the Spartacus box set out there, a lot of collectors who have room in their budget for one box set have just gone with the one they feel is more essential (no surprises North might prevail to long-standing collectors). Mind you, I would never get the Jones box -- there'd be no point giving me one for Christmas, as from my memory of that show, while it's good for TV (and particularly for that time), it just isn't what I listen to. What surprises me is not that it's been available on file sharing sites, but that anyone who wasn't a devotee of the show would download it in the first place. And if they are a devotee, then I'm very surprised they haven't. (Surely that is a small set of consumers?)

    Mind you, I do get where Lukas and others come from when they feel their efforts are being enjoyed by others costlessly. And where it's meaningful here is that there is utility being derived by these consumers, but their enjoyment of the product cannot alleviate the cost strain to the producer, as their enjoyment is unobserved. And it's not an anonymous company here -- these are fairly small businesses in the end, they need the revenue. (Mind you, if I was an investing man, given this situation, the last business I'd be investing in is music distribution right now.)
